Through eviction, the owner or landlord seeks the recovery of the property that he had rented. The reason is usually the lack of payment, in which case, together with the demand for eviction, the income claim is made, but it can also be for any other contractual breach, legal cause, or simply due to the termination of the contract.

To file an eviction claim, the intervention of a lawyer and procurator is necessary.

Once the eviction claim is presented, the court will proceed to admit it for processing and will transfer it to the other party, who will have a period of 10 days to oppose it. If you do not object, it will proceed to the launch within the period already pre-established by the court in the transfer, without the need for a trial. In case of opposition, a trial will be held, after which the sentence will be obtained.

Regarding the duration, despite the fact that this type of procedure has been improved and accelerated, depending on the volume of cases of each court, from the time the claim is filed until the launch occurs, between 3 and 6 months may elapse, in some cases even more, so we recommend starting the procedure as soon as possible and not postponing the time.
